Appeals

There is a right of appeal to the Secretary of State when planning permission is refused or enforcement action taken against unauthorised development. There are three forms that appeals can take;


• Written Representations

• Informal Hearings

• Inquiries


Appeals are a significant part of our workload. Our success rate of just over 50% is better than the national average of 1 in 3.

We are experienced in all three forms of appeal.


Written Representations - For most written representation appeals the work will be entirely within the practice.


Hearings - Hearings will not normally require outside assistance but when the outcome hangs on particular issues, like highway safety, it may be necessary to call in other practices.


Inquiries - Inquiries almost always require a number of specialist witnesses and the case will often be presented by a barrister. Our role is likely to be in assembling and coordinating the inquiry team and in presenting specialist planning evidence.
